Surrogacy expenses in Ireland

How to plan reimbursement fairly, keep evidence and distinguish genuine costs from compensation without treating future statutory rules as operational.

Current-law warning: section 58 of the 2024 Act describes reasonable expenses in the enacted domestic framework, but the principal domestic-surrogacy provisions remain uncommenced. Obtain current advice before making or accepting payments.

Expenses are not a fee for pregnancy

Reimbursement is intended to prevent a surrogate being left financially worse off because of an arrangement. Compensation or reward is different: it is payment for carrying the pregnancy. The legal distinction can depend on the applicable jurisdiction, the purpose of a payment, evidence and whether an amount is proportionate.

Build an expense policy before treatment

  1. List categories rather than promising a single lump sum.
  2. Decide how estimates, receipts and reimbursement timing will be recorded.
  3. Provide a method for urgent or unexpected expenditure.
  4. Ensure each party can obtain independent advice about disputed items.
  5. Review the policy if circumstances change, without pressuring medical decisions.

Avoid misleading “surrogate salary” figures

Global search results often quote commercial-programme compensation from other countries. Those figures do not establish what is lawful or appropriate in Ireland. Likewise, a large programme price may combine clinic, agency, legal, donor, insurance and travel charges; it is not necessarily an amount received by the surrogate.

International arrangements

Payments may be governed by the destination country's law as well as create questions under Irish law. Request a complete written schedule showing who receives each payment, whether any refund applies, how client money is protected and how the surrogate receives independent advice. Currency changes, failed cycles, multiple pregnancy, neonatal care and travel delay should sit in a separate contingency budget.
